Arizona Voter Roll Maintenance Challenge

Mussi v. Fontes

Lawsuit filed by the chair of the Republican Party of Arizona Gina Swoboda, the president of Arizona Free Enterprise Scott Mussi and a voter against the Arizona Secretary of State Adrian Fontes (D) challenging the state’s maintenance of its voter rolls. The plaintiffs claim that at least four counties have more registered voters than adults over the age of 18, and the state’s remaining counties have voter registration rates between 80-99%. They allege that these numbers far exceed the national and statewide voter registration rates. The plaintiffs claim that the lack of a list maintenance program, which the secretary of state explains is still in development, violates Section 8 of the National Voter Registration Act. They ask the court to order the state to develop and implement a program to remove ineligible registrants from the state’s voter rolls.

STATUS: The plaintiffs filed their complaint on June 3, 2024. The Arizona secretary of state has not responded yet.
