United Sovereign Americans v. Byrd
Lawsuit filed by United Sovereign Americans, Citizens Defending Freedom, one voter and eight Republican candidates running in the 2024 general election against Florida Secretary of State Cord Byrd (R), Florida Attorney General Ashley Moody (R), U.S. Attorney General Merrick Garland and the Florida Division of Elections challenging the state’s procedures related to voter rolls and its overall voting system. The plaintiffs allege that the state has failed to remove ineligible voters from its voter rolls in violation of the National Voter Registration Act (NVRA) and Florida law. They also argue that the state’s inaccurate voter rolls violate the Help America Vote Act (HAVA) by exceeding the federal error rate acceptable in a state’s voter systems, which is approximately one error in every 125,000 votes. The plaintiffs ask the court to compel officials to adequately investigate and remedy the current errors in Florida’s voter registration systems and to order the state to adopt new voter registration procedures. The plaintiffs also ask the court to order the state to submit voter registration requests to the U.S. Department of Homeland Security to verify the individual’s citizenship status. Finally, they ask the court to block the state from certifying the 2024 general election until the defendants demonstrate the election was lawfully conducted.
STATUS: The plaintiffs filed their complaint on Aug. 19, 2024. Litigation is ongoing.
