Adams v. Fulton County

Lawsuit filed by Fulton County Board of Elections and Registration member, Julie Adams (R), against Fulton County challenging Adams’ duty to certify election results. Adams previously filed a lawsuit to establish her right not to certify election results after she refused to certify the results of the county’s May 2024 primary elections. That case was dismissed on Sept. 9, 2024. 

In this lawsuit, Adams argues that each individual member should have the discretion on whether to vote yes or no for certifying election results because only county boards of elections have a duty to certify under state law, not individual members. She also argues that members of county boards of elections should be provided full access to any election related material. Adams asks the court to rule that the duty to certify election results is discretionary for individual members of county boards of elections and that all members must have full access to all election-related materials.

STATUS: Adams filed her complaint on Sept. 12, 2024. A hearing was held on Oct. 1, 2024.
