Driscoll v. Stapleton
Lawsuit brought by the Montana Democratic Party and Democratic Senatorial Campaign Committee challenging two voting restrictions: a law that restricts ballot collection and a requirement that absentee ballots must be received by the county elections office by 8 p.m. on Election Day. The trial court granted a preliminary injunction blocking state officials from implementing the challenged laws. The Montana Supreme Court affirmed the preliminary injunction against the ballot collection restriction, but vacated the district court’s order and set the absentee ballot deadline to 8 p.m. on Election Day.
