Nevada Carson City and Storey County Voter Challenges Lawsuit
Citizens Outreach Foundation v. Hoen
Petition filed by Citizen Outreach Foundation and a voter against Carson City Clerk Scott Hoen and Storey County Clerk Jim Hindle challenging local officials’ failure to process voter challenges. In July 2024, Charles Muth and the Pigpen Project filed several voter challenges in almost every Nevada county. On Aug. 27, 2024, the Nevada secretary of state issued guidance requiring voter challengers to have personal knowledge of the facts supporting their challenge of another voter’s eligibility. The petitioners allege that Carson City and Storey County violated state laws by refusing to process their voter challenges and notify the voters, even though the petitioners attest to personal knowledge of the facts in their voter challenges. Petitioners seek a court order requiring the counties to process voter challenges submitted by the Pigpen Project.
The petition was filed on Sept. 20, 2024.
On Sept. 26, the Nevada secretary of state and three pro-voting organizations, RISE, Institute for a Progressive Nevada and the Nevada Alliance for Retired Americans, filed motions to intervene.
On Sept. 27, the court granted the secretary of state and the pro-voting groups’ motions to intervene. Litigation is ongoing.
RESULT: On Oct. 12, the plaintiffs announced that they plan to withdraw the lawsuit.
