Nevada Nye County Nonpartisan Election Observers Limitations Challenge

Lawsuit filed by the ACLU of Nevada and one of its employees against Nye County and an interim county clerk challenging Nye’s policy of limiting nonpartisan election observers during the 2024 presidential primary. The ACLU alleges that during the state’s February 2024 presidential primary, local election officials told a staff attorney — who was sent by the ACLU to observe the county’s election process — that he could not observe the check-in or voting areas of a polling location. The local officials told this attorney that only one nonpartisan observer was allowed in a given area at a time. The ACLU argues this violates the state’s election laws and constitution. It asks the court to order the county to stop limiting nonpartisan observers’ access to its election process during the 2024 general election.
The plaintiffs filed their complaint on Sept. 10, 2024.
RESULT: According to local reporting, on Oct. 28, 2024, the ACLU of Nevada settled this case with Nye County. Nye County will allow nonpartisan election observers to observe the 2024 general election.
