Aguilar v. Washoe County Board of County Commissioners

Petition filed by Nevada Secretary of State Fransisco Aguilar (D) against three Republican members of the Washoe County Board of County Commissioners challenging their refusal to certify the results of the June 2024 primary election. On June 25, 2024, three unsuccessful primary candidates requested recounts in their respective races. On July 9, the Washoe County Board of Commissioners voted 3-2 not to certify the results of two of those recounts. Aguilar argues that the commissioners have a mandatory duty to certify election results under state law. Aguilar asks the state Supreme Court to order the commissioners to certify the results of the recounts by Aug. 22, 2024. On July 16, the Washoe County Board of County Commissioners met again and voted 4-1 to certify the results.

RESULT: On Aug. 19, 2024, the Nevada Supreme Court dismissed this case as moot.
