Toulouse Oliver v. Otero County Commission
Petition for a writ of mandamus filed by New Mexico Secretary of State Maggie Oliver Toulouse (D) against the Otero County Commission for failing to certify primary election results. The commission refused to certify Otero County’s election results on the basis of unfounded claims about voting machines. The commission identified no actual deficiencies in the election results in support of its vote to not certify results. The New Mexico Supreme Court ordered the commission to comply with its statutory duty and certify the election results by Friday, June 17. The commission voted 2-1 to certify the results.
