Pennsylvania Bucks County On-Demand Mail-in Ballot Application Issues Lawsuit

Lawsuit filed by Donald J. Trump for President 2024, the Republican National Committee (RNC), Republican Party of Pennsylvania, Republican candidate for U.S. Senate David McCormick and Friends of Dave Campaign against the Bucks County Board of Elections and its members seeking to extend Bucks County’s deadline for in-person mail-in ballot applications. In Pennsylvania, voters must request a mail-in ballot by Oct. 29, 2024 in order to vote by mail in the November 2024 general election. One option for voters seeking to vote by mail is to request their mail-in ballot in person at the county’s Elections Bureau.
The plaintiffs claim that in the days preceding the Oct. 29 deadline, Bucks County turned away voters who were waiting to request their mail-in ballot “because of long lines and closing of sites earlier than posted hours where voters were told they would be able to exercise this option.” They argue that the county’s decision to turn away voters waiting to request a mail-in ballot violates Pennsylvania law. They ask the court to order Bucks County to allow voters to apply for and receive a mail-in ballot at the county’s Elections Bureau office before the close of business on Oct. 30, 2024 — one day after the state deadline.
STATUS: The Republican plaintiffs filed their complaint on Oct. 30, 2024. The same day, the court granted their motion for a preliminary injunction, which allows any voter who wishes to apply for or cast a mail-in ballot to appear at the county’s Elections Bureau prior to the close of business on Nov. 1.
