Pennsylvania Bucks County Provisional Ballot Missing Signature Challenge
McCormick v. Bucks County Board of Elections
Lawsuit filed by Republican candidate for U.S. Senate, David McCormick, the Republican National Committee (RNC) and the Republican Party of Pennsylvania against the Bucks County Board of Elections challenging the board’s decision to count 100 provisional ballots missing the signature of the voter, judge of elections or minority inspector in the November 2024 general election. The Republican plaintiffs claim that the decision violates Pennsylvania law — which requires provisional ballots to be signed by the voter, the judge of elections and the minority inspector — and ask the court to prohibit Bucks County from counting provisional ballots missing the signature of the voter or election officials required by state law.
RESULT: On Nov. 20, 2024, the court granted and denied in part the Republican plaintiffs’ petition. Provisional ballots submitted without a voter’s signature will not be counted in the November 2024 election results, but provisional ballots missing a judge of elections or minority inspector’s signature will be counted.
