Walsh v. Luzerne County
Lawsuit filed by Republican candidate for Pennsylvania’s 117th House District, Jamie Walsh, against Luzerne County, Luzerne County Bureau of Elections and Luzerne County Board of Elections and Registration challenging the county’s delay in processing mail-in ballot and voter registration applications for the November 2024 general election. In Pennsylvania, individuals must submit their voter registration applications before Oct. 21, 2024 in order to cast a ballot in the November 2024 general election. Walsh claims that Luzerne County has not processed approximately 2,500 voter registration applications that were submitted prior to the Oct. 21 deadline. He also alleges that the county has failed to process and distribute ballots for thousands of mail-in ballot requests. Walsh argues Luzerne County’s delay in processing these applications violates the Pennsylvania law and the First and 14th Amendments of the U.S. Constitution, and asks the court to order the county to process all outstanding voter registration and mail-in ballot applications ahead of the November 2024 general election.
STATUS: On Oct. 30, the case was removed to federal court, where litigation is ongoing. On Nov. 4, the plaintiff withdrew his motion for a preliminary injunction.
