Virginia Noncitizen Voter Purge Program Challenge (DOJ)

United States of America v. Beals

Lawsuit filed by the U.S. Department of Justice (DOJ) against the state of Virginia, Virginia State Board of Elections and Virginia Commissioner of Elections Susan Beals challenging the state’s recent voter purge efforts. On Aug. 7, 2024, the Virginia governor issued Executive Order 35, which provided instructions for a new purge program meant to remove noncitizens from the state’s voter rolls. The DOJ claims the program violates the National Voter Registration Act (NVRA) — which mandates that no voter cancellation can occur within 90 days of an election. The DOJ asks the court to order the state to halt the voter purge program until after the November 2024 general election and to restore and notify all voters who were wrongfully purged from the state’s voter rolls.

STATUS: The DOJ filed its complaint on Oct. 11, 2024. On Oct. 18, the case was consolidated with Virginia Coalition for Immigrant Rights v. Beals, where all future filings can be found.
