Lawsuit filed by a Wisconsin voter against the Wisconsin Elections Commission (WEC) and its administrator, Meagan Wolfe, challenging WEC’s approval of a new absentee ballot envelope. In Wisconsin, any returned absentee ballots must include a copy of the original ballot request signed by the voter in order to be counted. In August 2023, WEC approved the use of a new “absentee certificate envelope” design that can be used as a copy of the original request form to certify an absentee ballot. The voter argues that by enforcing the use of this new envelope, WEC is implementing a new administrative rule without legislative oversight in violation of Wisconsin law. The voter asks the court to ban WEC from enforcing the use of the new absentee certificate envelopes and to order that WEC properly implement the envelope as an administrative rule.
RESULT: The voter filed his complaint on Aug. 22, 2024. On Nov. 13, the court dismissed the case.
