McCole v. Wisconsin Elections Commission

Lawsuit filed by a municipal election clerk and a voter against the Wisconsin Elections Commission (WEC) challenging the integrity of Wisconsin’s online elections portal. MyVote is Wisconsin’s statewide online portal that allows voters to register to vote and request absentee ballots. An individual can request an absentee ballot through MyVote by providing a Wisconsin voter’s name and birth date, which can be sent to any address. The plaintiffs argue that MyVote’s current system does not have an adequate cybersecurity system in place to prevent unauthorized individuals from requesting another voter’s absentee ballot. They claim MyVote’s system violates the 14th Amendment of the U.S. Constitution, and ask the court to immediately ban WEC from using MyVote until it has been redesigned with a better cybersecurity system. The plaintiffs also ask the court to order WEC to conduct a security audit of MyVote to identify any potential election fraud that may have already occurred.

STATUS: The plaintiffs filed their complaint and motion for preliminary injunction on Oct. 21, 2024. WEC has not responded yet.
