Wisconsin Voter Roll Maintenance Challenge

Oldenburg v. Wisconsin Elections Commission (IV)

Lawsuit filed by a voter against the Wisconsin Elections Commission (WEC) and its administrator, Meagan Wolfe, challenging the state’s voter roll maintenance policies. In Wisconsin, the state’s voter registration list includes both active and inactive voters. Inactive voters include voters who are no longer properly registered electors, including felons, dead persons and individuals who have moved out of state. The voter claims that this system allows inactive registrants to be designated as active voters at any time by changing the voter’s status within the database. He argues WEC’s registration system violates Wisconsin law by keeping inactive voter records in the same database as the state’s active voter registration list, which he claims allows a voter’s status to be changed from inactive to active at any time. The voter asks the court to order WEC to recompile its voter registration list in a format that does not allow inactive records to be reactivated. 

RESULT: On Oct. 23, 2024, the court granted WEC’s motion to dismiss. Wisconsin’s current voter roll maintenance policies will remain in place.
